Our General Terms & Conditions

Article 1 – Price and Taxes

• EU Customers: Prices are indicated in Euros (€) inclusive of French Value Added Tax (VAT). For deliveries within the European Union, the tax rate applied is based on the regulations of the destination country.

• Non-EU Customers (including USA): For goods dispatched outside the EU, prices are automatically calculated and payable net of tax, in Euro (€).

• Import Duties: For orders delivered outside of mainland France, you are the importer of record. You are responsible for all customs duties, local taxes, import duties, or state taxes. You are responsible for both the payment and the necessary declarations to the appropriate authorities in your country.

• Quotes: Quotes for professionals will show prices net of VAT and the VAT separately.

• Price Modifications: Vraiment Beau reserves the right to modify prices at any time. Products are invoiced based on the rates valid at the time of order submission. Quoted prices are valid for 6 months following the order or quote submission.

Article 2 – Ordering and Language

• Channels: Orders can be placed online at www.vraimentbeau.com or by telephone at +33 (0)1 45 20 60 00 (Monday to Friday, 09:00 to 18:00 CET).

• Language: Contractual information is presented in French. In the event of a discrepancy between the French version and this English translation, the French version shall prevail.

Article 3 – Order Confirmation

• Acceptance: Submission of an order constitutes acceptance of these Terms and Conditions.

• Binding Contract: The contract is only binding once confirmed by Vraiment Beau via email. We reserve the right not to confirm an order (e.g., supply issues, suspicious activity, or technical errors).

• Proof: Data recorded by Vraiment Beau constitutes proof of all transactions.

Article 4 – Product Availability

• Quantity Limits: Vraiment Beau is a retailer; we reserve the right to refuse large-quantity orders.

• Stock: Offers are valid while visible on the site and while our manufacturers keep distributing the ordered items. If an item becomes unavailable after your order, you will be notified via email and reimbursed immediately.

Article 5 – Delivery and Inspection

• Zones: We deliver to countries listed in the "Your Basket" dropdown. For other countries, contact us for a quote.

• Fragile Goods: Although we take every care to package our products, lighting fixtures remain fragile. You must inspect the parcel immediately upon receipt. * Damage Protocol: If the item is damaged, you must refuse the delivery or sign the delivery note with precise, hand-written reservations (e.g., "Product broken inside - box crushed"). General reservations like "subject to unpacking" have no legal value.

• Claims: Reservations must be confirmed to the carrier via registered letter within three (3) working days, with a copy sent to Vraiment Beau. If you fail to do so, you will forfeit your rights to reimbursement, replacement or reparation.

Article 6 – Technical Compliance (CE and International Standards)

• Default Standard: Unless explicitly stated otherwise, all products comply with European Union standards (230V, 50Hz, CE).

• US & International Standards: Some manufacturers can customise fixtures for 110V/120V or specific foreign standards (UL/ETL components).

• Mandatory Request: If you require a non-European standard, you must explicitly state this in the "Delivery Special Instructions" field of the order form or contact us directly before shipment.

• Liability: Without an explicit request for customisation, Vraiment Beau is not liable for incompatibility with local electrical grids or building codes outside the EU.

Article 7 – Payment

• Timing: Payment in full is due upon ordering, unless otherwise specified (professional quotes).

• Methods:

  • Credit/Debit Card: Visa, Mastercard, American Express via secure SSL 2048-bit connection.

  • Wire transfer: you will find our account details on your order confirmation.

  • Cheque: Available only for banks based in mainland France or Monaco. Orders are processed only after the cheque is cashed.

Article 8 – Risk Transfer

• For Consumers: According to EU law, risk of loss or damage transfers to the customer only when the customer (or a third party designated by them) takes physical possession of the goods.

• For Professionals: The risk is transferred to the customer as soon as the goods are handed over by Vraiment Beau to the carrier.

Article 9 – Retention of Title

All goods remain the property of Vraiment Beau until full and final payment is received (French Law N°80 335 of May 12, 1980). In the event of non-payment, the customer undertakes to return the goods at their own expense upon first request.

Article 10 – Right of Withdrawal (Satisfaction or Refund)

• EU Residents: You have 14 days from receipt of goods to exercise your right of withdrawal without giving a reason.

• Refunds: We will refund the price of the goods within 14 days of receiving the returned items. You are responsible for the return shipping costs.

• Condition: Items must be returned in their original packaging, complete, and in new condition.

• Exclusions: This right does not apply to professionals or to products that have been customised or made to order (including fixtures specially adapted to 110V).

Article 11 – Legal Guarantees

• Standard Guarantee: Products (excluding consumables like bulbs) are covered by a 2-year guarantee against manufacturing defects, provided they are installed according to manufacturer recommendations.

• Claim Process: Contact us for a return number before shipping the item back at your expense for replacement or repair.

• US Customers: This is a Limited Warranty. You may have other rights that vary from state to state.

Article 12 – Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

1. CAP ON LIABILITY: VRAIMENT BEAU’S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM A PURCHASE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY THE CUSTOMER FOR THE PRODUCT IN QUESTION.

2. EXCLUSION OF DAMAGES: VRAIMENT BEAU SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER (INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF USE, LOSS OF DATA, BUSINESS INTERRUPTION, PROPERTY DAMAGE, OR COST OF SUBSTITUTE GOODS OR SERVICES), HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, EVEN IF VRAIMENT BEAU HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Article 13 – Personal Data (GDPR)

In accordance with the GDPR and French "Informatique et Libertés" legislation, you have the right to access, rectify, or delete your personal data. We only store information necessary for invoicing and order processing. Contact us at contact@vraimentbeau.com to exercise your rights.

Article 14 – Applicable Law

This contract is subject to French Law. In the event of a dispute, French courts shall have exclusive jurisdiction, even in the case of multiple defendants or the introduction of third parties.

Article 15 – Fraud

• All our systems are secured to the maximum reasonable extend permitted by e-commerce technologies. You remain responsible to verify that you interact with legitimate instance: this is true for pages branded as Vraiment Beau, for the pages presented by financial institutions for payment (Sogecommece & Paypal), and emails sent on our behalf.

• The Internet is seeing an increasing number of fake sites, that replicate e-commerce sites or their product catalogs, often with very attractive rebates. You should always verify that you are on our site pages.

• If you have any doubt about the legitimacy of any request related to Vraiment Beau in writing or on the phone, you should call us back directly for confirmation.

• Credit card details never pass through our systems and are never stored on our servers: we therefore cannot be held responsible for any credit card fraud.

• We do not accept responsibility for products bought on other sites or at other retailers.
